Terms of Service

These Terms govern your use of daviah.io, operated by Daviah IO LLC ("Daviah").

Acceptance

By using daviah.io you agree to these Terms. If you do not agree, do not use the site.

Scope

These Terms cover the public marketing site, waitlist signup, contact form, and demo booking. Use of the Daviah compliance platform is governed by a separate Master Services Agreement between you and Daviah.

Acceptable use

You agree not to:

• Use the site for any unlawful purpose.
• Scrape, harvest, or copy site content at scale without written permission.
• Interfere with the site's operation, security, or other users' access.
• Submit false, misleading, or third-party information through our forms.

Intellectual property

All site content, branding, and software are owned by Daviah IO LLC or its licensors. You may not reproduce, modify, or redistribute site content without written permission, except for normal browsing and sharing of public URLs.

No warranty

The site is provided "as is" without warranty of any kind. Daviah does not warrant that the site will be uninterrupted, error-free, or secure.

Limitation of liability

To the maximum extent permitted by law, Daviah will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the site.

Termination

We may suspend or terminate your access to the site at any time, including for violation of these Terms.

SMS text messages

Program name: Daviah Appointment Confirmations.

If you book a demo with us, we send text messages about that appointment: a confirmation once a member of our team confirms it, and a notice if it is rescheduled or cancelled. This is a transactional program: we do not send marketing or promotional text messages, and we never share your number with third parties for their own marketing.

• How you opt in: two ways, and only these two. (1) Verbally, during a phone call you place to us — after a time is agreed we ask separately and explicitly whether we may text you, and only send one if you say yes. (2) By ticking the optional, unchecked SMS box on our booking form at daviah.io/daviah/book. The exact wording of both is published at daviah.io/sms-consent-script.
• Consent is never required. Agreeing to receive text messages is not a condition of booking an appointment, of purchase, or of any service we provide. Decline and you still get the appointment, confirmed by email instead.
• Message frequency: varies — typically a sign-up confirmation, an appointment confirmation, and a notice only if the appointment changes or is cancelled.
• Message and data rates may apply. Your mobile carrier's standard rates apply to messages you send and receive.
• To stop receiving messages, reply STOP to any message. You will receive a confirmation and no further messages.
• For help, reply HELP to any message, or email support@daviah.io.
• Carriers are not liable for delayed or undelivered messages.
• We do not share your mobile information. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
• How we handle your data is described in our Privacy Policy.

Governing law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the site will be brought exclusively in the state or federal courts located in California.

Changes

We may update these Terms. Continued use of the site after changes are posted constitutes acceptance.
